摘要 家务劳动补偿制度是立法机关为消除女性在家庭内部长期受到的劳动剥削,基于权利和义务对等原则作出的制度创新。从女性主义视角看,该制度的提出回应了“男主外、女主内”的传统劳动性别分工、女性因为承担更多家务劳动而面临脆弱性的现实,以及公私二元论下法律对此贯持的默认态度。法律对劳动性别分工的纠正,肯定了家务劳动的经济价值,有益于提升女性在家庭以及社会中的地位。由于未充分纳入关注女性特殊性的关怀伦理,该制度也存在某些不足。通过调整权利行使时间、设定科学的计量方法、明确补偿形式,或可弥补之。 The compensation system for household duties is an institutional innovation made by the legislature on the basis of the reciprocal principle of rights and obligations in order to eliminate the long-term exploitation of women in the family.From the feminist view,the system’s proposal responds to the traditional gender division of labor“men work outside,and women work at home”,the reality that women face vulnerability as a result of taking on more domestic work,and the default attitude of the law under the dualism of public and private.The correction of the gender division of labor by law,recognizes the economic value of domestic work,which helps to improve the status of women in family and society.There are also some shortcomings in the system because it is not fully integrated into care ethics which focus on women’s particularity.By adjusting the practice time of rights,setting scientific measurement methods,clear forms of compensation,we can make up for it.
