大数据下个人信息侵权与保护法律问题研究

Research on the Legal Issues of the Infringement and Protection of Personal Information under Big Data

大数据时代防范和打击个人信息侵权行为是信息保护法的关注重点,数据时代信息获取途径更加便捷,适用范围更加广泛。而大数据具有智能化、动态化以及隐蔽化的特征,其中的侵权行为不易把控,亟须加强相关领域的专门立法。2021年11月实行的《中华人民共和国个人信息保护法》在一定程度上规制了信息侵权行为,然而在数据信息的保护中却存在无法规避的外部障碍,通过分析和研究这些障碍,不仅可以有力地打击信息侵权行为,还可以找到障碍的突破口,使得《个人信息保护法》在大数据时代能够更好地践行。

In the era of big data,preventing and combating personal information infringement is the focus of the information protection law. The information access way is more convenient, and the application scope is wider. Big data have intelligent,dynamic and concealment characteristics,in which the infringement is not easy to control, so it is urgent to strengthen the special legislation in related fields. In November 2021,the Personal Information Protection Law came into effect. To a certain extent,it regulates the information infringement,but in the data information protection it cannot avoid external obstacles. Analysis and research of these obstacles not only can effectively combat information infringement,but also can find the breakthrough of obstacles and make the Personal Information Protection Law run better in the era of big data.
