摘要
为了验证高校图书馆提供在线教育服务是否正确地利用合理使用原则,本文运用案例研究方法分析国内外高校图书馆在线教育服务合理使用案例的争议焦点及相关问题,启发我们对在线教育服务中合理使用原则的再思考。期望通过著作权立法的完善(制定教育机构著作权安全港)、图书馆在线教育合理使用政策的修订、图书馆自开发的教育合理使用工具的利用,可以免除图书馆在线教育服务侵犯著作权的责任并增加其符合合理使用原则的潜力。
In order to verify whether the fair use principle is correctly utilized in online education service provided by university libraries,the paper conducts case study to analyze some typical legal cases,their disputes and related issues over the fair use in online education services provided by university libraries in both China and abroad.The case study inspires us to rethink about the principle of fair use in online education services.It is our hope that libraries will not be held liable for the infringement of copyright in online education services of library and will be increased the possibilities in conformity with fair use principle through the improvement of copyright legislation(establishing a copyright safe harbor for educational institutions),revisions of the library’s policy on fair use of online education,and utilization of the educational fair use tools developed by the libraries themselves.
