Antitrust Regulation of Data Sharing Among Platform Enterprises

[研究目的]平台企业数据共享是维护市场安定、保护国家经济安全中的重要一环,数据所具有的竞争法品性,使得平台企业数据共享需要被纳入反垄断法进行规制。[研究方法]在反垄断背景下分析平台企业滥用数据优势的行为及危害,进而阐述平台企业数据共享的理论根源和实践现状。从平台市场竞争失序的理论根源研究出发,据此提出平台企业数据共享的理论支撑。对平台企业数据共享现状进行研究,发现平台企业数据共享运作机制存在着市场垄断风险。[研究结论]反垄断视角下,构建平台企业数据共享制度,主要从三个方面出发:一是创建平台企业流通共享企业数据的强制共享机制,二是制定平台企业数据共享的官方指南,三是完善平台企业数据共享市场的公平保障措施。

[Research purpose]Data sharing among platform enterprises is an important part of maintaining market stability and protecting national economic security.Due to the nature of data in competition law,data sharing among platform enterprises needs to be regulated by antitrust laws.[Research method]In the context of anti-monopoly,this paper analyzes the behaviors and harms of abusing data advantage of platform enterprises,and then expounds the theoretical root and practical status quo of data sharing of platform enterprises.Based on the theoretical root of platform market competition disorder,the theoretical support for platform enterprise data sharing is proposed.By studying the current situation of data sharing of platform enterprises,it is found that the operation mechanism of data sharing of platform enterprises has market monopoly risk.[Research conclusion]From the perspective of anti-monopoly,the construction of platform enterprise data sharing system mainly starts from three aspects:first,to create a compulsory sharing mechanism for platform enterprises to circulate and share enterprise data;second,to formulate official guidelines for platform enterprise data sharing;third,to improve the fair guarantee measures for platform enterprise data sharing market.
