摘要
西方国家近现代规划立法的诱因,源于政府对突发公共卫生事件的重视和干预,我国则不然。从“非典”到新冠肺炎,学界对规划如何监测、预防和应对突发公共卫生事件的探讨从未间断。但是,规划与突发公共卫生事件立法中的衔接不足、规划空间尺度与紧急权错位、科学支撑体系不足等,制约了规划在疫情防控中发挥更大的作用。文章旨在系统总结中外规划立法和突发公共卫生事件管理的理论与实践,分析其衔接的问题,反思规划立法对突发公共卫生事件管理的价值,进而为完善规划立法提供建议和借鉴。
Modern planning legislation in Western countries originates from the government intervention in public health emergencies.Comparatively,the Chinese academia has never stopped its efforts on how to monitor,prevent and respond to public health emergencies from“SARS”to“COVID-19”.However,the inadequate connection between planning and legislation of public health emergencies,the dislocation of spatial scale and emergency right,and the lack of scientific support system have constrained planning playing a greater role in epidemic prevention and control.This paper systematically summarizes the theory and practice of planning legislation and public health emergency management in China and abroad and analyzes the existing connection problems.In addition,it reflects on the significance of planning legislation for public health emergency management,and proposes suggestions and provides a reference for improving planning legislation.
