RCEP背景下国际知识产权新规则评述及中国应对

Research on the New Rules of International Intellectual Property Rights in the Context of RCEP and China’s Response

作为目前世界上涵盖人口最多,经贸规模最大的自由贸易区和当前中国最重要的自由贸易区协定,RCEP的知识产权条款在原先TRIPS协定的基础上顺应时代变化,对TRIPS协定中的部分知识产权规定进行了时代更新,全面提升了区域内的知识产权保护水平。RCEP的知识产权条款更加顾及自由贸易区内各缔约方之间的利益平衡,这对于WTO多边贸易框架下TRIPS协定未来的修改具有示范意义。从统筹国内外法治的角度看,中国在RCEP生效后的国内履约义务上,还有一定的提升空间,本文以提升未来中国参与国际知识产权规则制定的能力和话语权为目标,分析提出了RCEP背景下国际知识产权新规则下中国的应对建议。

As the most populous free trade area with the largest economic and trade scale in the world and the most important free trade area agreement in China at present,RCEP has modified and updated some of the intellectual property rights(IPR)provisions of the TRIPS Agreement in response to the changes of the times,and the level of IPR protection in the region has been comprehensively enhanced.The IPR provisions of RCEP take into account the balance of interests among the parties in the free trade area,which is of exemplary significance for the future revision of the TRIPS agreement under the WTO multilateral trade framework.From the perspective of coordinating the rule of law at home and abroad,there is still room for China to improve its domestic compliance obligations after the entry into force of the RCEP.This paper aims to analyze and propose recommendations for China’s response under the new international IPR rules in the context of RCEP,with the goal of improving China’s ability and discourse power to participate in the rule-making of international IPR in the future.
