Legal Dimensions of Whole-process People’s Democracy

全过程人民民主理念,可从持续民主、真实民主、广泛民主、协商民主四个法治向度上进行阐析。持续民主意味着民主在阶段上、时间上、空间上是连续而不间断的机制,能够保证人民群众持续地参与国家和社会事务的管理。真实民主既体现为通过创造机会和条件,让人民群众拥有更多渠道、更多方式参与国家和社会事务的管理,也体现为在民主的实践过程中,注重保护少数人的权利和正当利益。广泛民主则表明,从国家制度运行到基层社会生活,从选举中到选举外,广大人民群众都能全面深入地参与到国家、社会事务以及自身事务的管理之中。协商民主是全过程人民民主的实现方式,其以商量为形式,以真实为标准,以共识为目标,同时统合多种协商渠道,使民主融入党和政府工作的各环节和人民群众政治、社会生活的各方面。

From the perspective of rule-of-law, the theory of whole-process people’s democracy could be interpreted in four dimensions, that is, continuous democracy, authentic democracy, extensive democracy, and consultative democracy. Continuous democracy means that democracy is continuous and uninterrupted in terms of process, time, or space, so as to ensure the continuous participation of the people in the management of state and social affairs. Authentic democracy means providing opportunities and conditions for the people to participate in the management of state and social affairs through more channels and methods and attaching more importance to the protection of legitimate rights and interests of minorities in practice. Extensive democracy means that the people are able to comprehensively and deeply participate in the management of state, social and their own affairs from the operation of the state system to grassroots social life, from election to non-election matters, and from governance to self-governance. Consultative democracy is the means to realize the whole-process people’s democracy. It takes consultation as the form, authenticity as the standard, and consensus as the objective, combines all the channels of consultation, and integrates democracy into all links of the work of the Party and the government and all aspects of the political and social life of the people.
