反腐败国际资产分享是国际刑事司法合作领域中的一种国家实践。境外追赃面临的实践难题要求我国建立健全反腐败国际资产分享机制予以应对。可立足我国在立法和实践层面的本土资源,以及他国在规范本体、运行机制和适用场域方面的国家实践,设计我国反腐败国际资产分享机制。可通过基本措施、配套措施、替代措施三种路径设计符合我国实践需要的反腐败国际资产分享机制,以健全反腐败领域的资产追回制度,提高资产分享效率。

Anti-corruption international asset sharing is a state practice in the field of international criminal judicial cooperation. The practical difficulties faced by overseas asset recovery require the establishment of a sound anti-corruption international asset sharing mechanism to deal with it. China,s anti-corruption asset sharing mechanism can be designed in combination with local resources at the legislative and practical levels, as well as other countries,national practices in normative ontology, operating mechanism, and applicable fields. The international asset sharing mechanism that meets the needs of China,s practice can be designed through three paths: basic measures, supporting measures, and alternative measures, so as to improve the asset recovery system in the field of anti-corruption and improve the efficiency of asset sharing.
