网购平台非司法纠纷解决机制(ODR)的不足及建议——以二手平台闲鱼小法庭为例

随着网络购物平台的兴起,大量的电子商务纠纷随之而来,但由于司法诉讼压力大,超小额案件的进入可能会造成司法资源浪费。《最高人民法院关于人民法院进一步深化多元化解纠纷解决机制改革的意见》中提出“互联网+”战略要求,推广现代信息技术在多元化纠纷解决机制中的运用。线上纠纷解决机制作为一种新的纠纷解决方式应运而生,它能使纠纷在平台内部解决,民间的实践有闲鱼小法庭等网购平台,通过对其进行分析发现存在较多的法律方面的不规范。本文通过案例分析和比较分析,对闲鱼小法庭和我国非司法纠纷解决机制的发展提供建议。

The rise of online shopping platforms has brought a large number of e-commerce disputes,but the appearance of super-small cases may cause a waste of judicial resources due to the high pressure of judicial litigation.Online dispute resolution mechanism has emerged as a new dispute resolution method,which enables disputes to be resolved within the platform.Civil practice includes online shopping platforms such as the small court of Xianyu,which is found to have more irregularities through legal analysis.This article provides suggestions for the development of the small court of Xianyu and the non-judicial dispute resolution mechanism in China through case studies and comparative analysis.
