数据是数字经济时代重要的战略资源,数据的价值提升能力事关一个国家数字经济的竞争力。平台经济的核心要素是数据,其发展存在“二律背反”难题。一方面,大平台企业是数字经济时代中国参与全球世界竞争的核心力量,需要大力发展;另一方面,其无序竞争则会促生平台数据垄断,破坏市场竞争秩序,并在消弭竞争的同时抑制创新。因此,发展平台经济,既要保护数据,又要破除数据垄断,以营造市场的公平环境,实现共同富裕。现有法律尚不完善,并不能从根源上规制平台经济无序竞争,需要研究并构建安全屏障下的数据保护、流通、共享与价值增值机制,形成事前、事中、事后全周期联动的“去中心化+中心化”的弱中心化平台经济数据确权、流通、价值增值及监管体系。

Data is an important strategic resource in the era of digital economy.The value promotion ability of data determines the competitiveness of a country's digital economy.The core element of platform economy is data,and there is an antinomy dilemma in its development.On the one hand,large platform enterprises are the core forces for China to participate in global competition in the era of digital economy and need to be developed vigorously,On the other hand,its disorderly competition will promote platform data monopoly,disrupt the market competition order,and inhibit innovation while eliminating competition.Therefore,to develop platform economy,we should not only protect data,but also break data monopoly,so as to create a fair market environment and achieve common prosperity.While the existing laws are not perfect and can't regulate the disorderly competition of platform economy from the root,it is necessary to study and build a data protection,circulation,sharing and value-added mechanism,form a"decentralized+centralized"weakly centralized platform economic data confirmation,circulation,value appreciation and supervision system before,during and after the event.
