New Reflection on Individual Subject Status in International Law

个人在国际法中的主体地位经历了漫长的“争论”后在国际法的部分领域得以确立并呈现出扩张趋势。在新形势下,处理好个人作为国际法上的主体与国家主权、主体范围、主体判断标准、主体权利义务等问题以及正确认识个人在国际法上的主体地位,已成为当务之急。确立个人在国际法部分领域的主体地位,扩张其权利义务,为个人提供在国际法中的发展空间,以实现和谐有序的国际法新格局。

The subject status of individuals in international law has been established and expanded in some fields of international law after a long"debate".Under the new situation,it is urgent to deal with the subject and state sovereignty,subject scope,subject judgment standard,subject rights and obligations of individuals as subjects in international law and to correctly understand the subject status of individuals in international law.To establish the subjective position of individuals in some fields of international law,to expand their rights and obligations,to provide individuals with a space for development in international law,and to realize a harmonious and orderly new pattern of international law.
