摘要
我国正努力构建知识产权纠纷多元化解机制。作为一种自力纠纷解决机制,侵权警告在查明、制止知识产权侵权方面具有效率高、成本低的优势,但恶意发送侵权警告者有四宗罪。由于我国立法上缺乏直接、系统的规制措施,不仅难以发挥侵权警告的工具价值,而且无法有效阻止恶意警告行为。借鉴域外立法规制侵权警告的经验与教训,对我国主要知识产权法进行集中修订,打造我国立法规制侵权警告的最简方案,将有利于切实发挥知识产权制度激励创新的基本保障作用。
China is striving to build a diversified IP dispute resolution mechanism.As an independent dispute resolution method,IP infringement warnings are cost-effective in identifying and curbing infringement of IP rights,but groundless warnings are destructive.Due to the lack of proper regulatory measures in China’s legislation,it is not only difficult to fully exploit the instrumental value of warnings,but also unable to effectively prevent groundless warnings.Drawing lessons to regulate infringement warnings from overseas legislation,uniformly revising China’s main IP laws,and adopting a minimalist approach in legislation to regulate infringement warnings in China will give full play to the fundamental role of IP system in stimulating innovation.
