摘要
宅基地“三权分置”改革以来,寻求宅基地盘活利用的方式和权利放活的路径成为宅基地制度改革的重要内容。本文认为,宅基地使用权入股具有市场化和财产化两大核心优势,与改革精神高度契合,能够促进宅基地的高效利用和价值转换。近年来,城市与农村关系的变化、农民与土地关系的变化虽为宅基地使用权入股提供了生存土壤,但构建宅基地使用权入股机制是一个从无到有的复杂工程,只有正确协调权益并厘清其中的价值冲突,才能冲破出资、运行、退出三大环节中的樊篱。
Since the reform of “Separation of Three Rights”of homesteads,an important part of the reform of the homestead system is to find ways to revitalize and utilize homesteads and to release the rights.Marketing and propertization are the two core advantages of using the use right of homesteads as shares,which are highly compatible with the reform and can promote the efficient use and value conversion of homesteads.Recent years have witnessed changes in the relationship between urban and rural areas,and the changes in the relationship between farmers and lands,which have provided a desirable environment for shareholding the use right of homesteads.However,the construction of the use right of homesteads shareholding mechanism is a complex project from scratch,and it is necessary to properly coordinate interests and clarify the conflicting values in order to crack the dilemmas in three major links:capital contribution,operation and exiting.
