司法以实现公平正义为己任,体现并落实在办案过程中对正义理念的践行。司法公正,如仅以抽象概念出现,则无力承担实质上指引司法实践的重任。因此,其应以一种相对具象的方式呈现,以契合司法办案的实际需求。在“文本法”的基础上,提出“内心法”概念,是以人民为中心司法理念的具体表达,明确指向内心价值遵循,并突出对人民利益的维护,注重治理效能提升的考量。对“内心法”的体认,有助于政治理念到司法实践的贯通和落实,从而确保司法输出更多的正义。“内心法”是为了挖掘“文本法”的实质内涵,其精髓在于清晰的正义逻辑和治理逻辑,并以实现更好效能为旨归。

In order to achieve fairness and justice,the judicial organs are required to practice the value of judicial justice in the process of handling cases.If it appears as an abstract concept,judicial justice cannot undertake the important task of guiding judicial practice in essence.Therefore,it should be presented in a relatively specific way to meet the actual needs of judicial handling cases.On the basis of "text law",the concept of "inner law" is put forward,which is the concrete expression of the people-centered judicial concept,clearly pointing to the inner value,highlighting the maintenance of the people’s interests,and emphasizing the improvement of governance efficiency.The recognition of "inner law" is conducive to the connection and implementation of political ideas into judicial practice,so as to ensure the judicial output of more justice."Inner law" is to explore the essence of "text law",the essence of which is clear logic of justice and governance,and to achieve better efficiency.
