摘要 基于不同原因引发的教育惩戒在处理程序上应有所区别。正当程序原则的适用范围需要限定,我们应警惕在大学学术治理中简单套用行政程序的做法。大学是追求真理的学术机构,而非行政听证室或法庭。对达不到学术标准学生的惩戒,无需适用像纪律性惩戒那样的刚性程序,比如行政意义上的听证会就是不必要的。这种程序不仅无助于化解纠纷,而且有害于学术自由。 Education discipline triggered by different causes should be procedurally distinct. It is necessary that the scope of application of due process principle be limited,and applying administrative procedures mechanically to the academic governance of a university deserves due vigilance. Universities are academic institutions in pursuit of truth,rather than administrative hearing rooms or courts. It is unnecessary that discipline of students who fail to meet academic standards should similarly follow rigorous procedures for disciplinary punishment,such as administrative hearings,which would be not only unhelpful in resolving disputes,but harmful to academic freedom.
