基于因果关系理论的自动驾驶汽车刑事责任探析 被引量:1

摘要 随着自动驾驶技术的平民化,自动驾驶汽车造成的交通事故数量也在不断地增加.由于目前没有与之配套的法律措施,危害结果发生后的后续问题无法得到及时、有效地处理,亟待制定相关制度来弥补这个缺位.根据现有法律文本、法律制度、法律理论,为无人驾驶汽车肇事后的刑事责任承担等问题提出解决思路.首先分析自动驾驶车辆的政策立法现状,为责任探析奠定基础;然后探讨自动驾驶对传统交通类犯罪的冲击;最后以传统因果关系理论为基础,提出自动驾驶时代刑事责任难题的解决思路. As autonomous driving technology becomes more and more popular,the number of traffic accidents by autonomous vehicles is increasing.Because there are currently no supporting legal measures,the follow-up issues after the occurrence of harmful results cannot be dealt with in time and effectively.Undoubtedly,relevant systems are needed urgently to make up for the lack of laws.Based on the existing legal texts,legal systems,and legal theories,we put forward a solution to the problem of the driver’s criminal responsibility after the driverless car accident.At first,we analyze the status and prospects of autonomous vehicles,which lay the foundation for the judgment of criminal liability;and then,we discuss the impact of autonomous driving on traditional traffic crimes;finally,we propose a solution to the problem of criminal liability in the era of autonomous driving.
