论民事在线庭审的困境及化解

On the Dilemma and Its Solutions of Civil Online Trial

在线庭审是以智慧司法为基础发展起来的新型庭审方式,借由防疫工作需要迅速推广。基于对民事案件在线庭审实际运行状况的考察,发现目前民事案件在线庭审陷入适用范围局限、依托第三方平台存在风险隐患、质证效果虚化、法庭秩序易失控的困境中。为帮助在线庭审摆脱困局,促进在线庭审良性发展,提出扩大在线庭审适用范围、建立第三方平台风险防范机制、提升在线庭审质证效果、预防在线庭审秩序失控等化解方案。

Online trial is a new type of trial developed on the basis of intelligent justice,which lends itself to the need for rapid promotion of anti-epidemic work.Based on the examination of the online trial operation for civil cases,it is found that the current online trial for civil cases is caught in the dilemma of limited scope of application,relying on the third-party platform with risk potential,vitiating the effect of cross-examination and easily losing control of court order.In order to help online trials get rid of the dilemma and promote the benign development of online trials,we propose solutions to expand the scope of application of online trials,establish a risk prevention mechanism for third-party platforms,enhance the effect of cross-examination in online trials,and prevent the loss of order in online trials.
