环境公益诉讼中的行民交叉问题研究——以行政附带民事诉讼“参照”适用为中心

Research on the Issues Crossed between Administrative and Civil Disputes in Environmental Public Interest Litigation: centering on the “Reference” Application of Administrative Litigation with Incidental Civil Action

环境公益诉讼中的行民交叉问题是公益诉讼的一个审判难题。在司法实践中探索创立环境行政附带民事公益诉讼,对这一问题的缓解具有积极意义,但它缺乏明确的法律依据。当前,环境公益诉讼可参照行政附带民事诉讼规则来解决行政和民事争议。以检察机关为主要的起诉主体,并尊重其他主体的程序地位;合理界定“环境”“公共利益”等要素,根据环境公益诉讼与行政附带民事诉讼范围来确定案件范围;立足我国环境公益诉讼审判的特殊性,以有效维护公益为目的,采取“一并审理”“合一审判”的审判方式。

The administrative-civil-crossed issue in environmental public interest litigation has been a difficulty in the trial of public interest litigation.The environmental administrative litigation with incidental civil action of public interest established in judicial practice has positive significance for alleviating this problem, but it lacks a clear legal basis.At present, administrative and civil disputes can be resolved together with reference to the administrative litigation with incidental civil action rules.We should take the procuratorate as the main subject of prosecution, and respect the procedural status of other subjects;reasonably define elements such as “environment” and “public interest”,and determine the scope of the case according to the scope of environmental public interest litigation and administrative litigation with incidental civil action;based on the specialty of China’s environmental public interest litigation trial, with the purpose of effectively safeguarding the public interest, adopt the trial methods of “joint trial” and “unified trial”.
