安顺大屯顶契所见田土交易形态研究

A Study on the Form of Land Transaction According to Datun Dingqi in Anshun

通过统计“安佃”一词在顶契、卖契和当契中的使用情况,发现大屯契约中顶契的田土交易本质上是田面权的转让,卖契中的“卖田骨契”是“田底权”的买卖关系。“卖田骨契”(田底权买卖)和顶契(田面权买卖)都是基于对存在租佃关系的田土进行交易的契约类型,因此“卖田骨契”不同于一般的买卖契约,其交易的田土通常要上纳田赋。此类契约在“叙物语”或“收价语”或“加批语”中都有所提及,这体现着大屯顶型买卖契约中交易的田土的租佃关系。

Through the statistics of the use of the word“An Dian”in Dingqi,the sale deed and the pawn deed,the analysis shows that the land transaction of Dingqi in the Datun contract is essentially the transfer of the land surface right,and the“sell land bone deed”in the sale deed is the sales relationship of the“land bottom right”.The“land bone deed”(land bottom right sale)and Dingqi(land surface right sale)are both contract types based on the transaction of the land with tenancy relationship.Therefore,the“land bone deed”is different from the general sales contract,and the land traded is usually subject to land taxes.Such contracts are mentioned in the“narrative”or“quotation”or“approval”,which reflects the tenancy relationship of the land traded in the Datun top sales contract.
