大数据时代网络深度链接行为的刑法治理研究

随着大数据时代的到来,网络深度链接行为成为一种新兴信息网络技术被广泛应用。网络深度链接行为有其自身特性,与《著作权法》中的复制行为、发行行为的特性截然不同,不属于后两者的范畴,其特性属于信息网络传播行为。网络深度链接行为在实施过程中构成间接侵权,侵权具有严重的社会性危害性,应当适用刑法进行治理,应设置侵犯网络著作权罪及认定侵犯信息网络帮助犯等方式作为网络深度链接行为入罪的路径,让网络深度链接行为得到规范,网络环境被净化,网络技术朝良性健康的方向发展,更加方便网络用户及为网络用户服务。

With the advent of the era of big data,network deep link behavior has become an emerging information network technology,which has been widely used.Network deep link behavior has its own characteristics,which are completely different from those of copying behavior and distribution behavior in Copyright Law.It does not belong to the category of the latter two behaviors,but belongs to the behavior of information network communication.Network deep linking behavior in the process of implementation of indirect infringement,serious consequences if the infringement,has serious social harmfulness,the criminal law shall apply to the governance,depth of the network copyright infringement crimes should be set up and decided that network links for infringement of information network crime to help make the web deep linking behavior into the path of sin,resulting in the specification,network deep linking behavior network environment was purified,toward the positive healthy development of network technology,more convenient network users and the service for network users.
