营商环境视角下健全绿色保险法治的路径

绿色保险法治是绿色保险治理的基本方式,要求将秩序、公正、效率等基本法治价值观贯穿整套绿色保险法律制度,实施前提是有符合“良法”标准的绿色保险法律制度。绿色保险法治的重要性,体现在通过促进绿色保险发展来间接促进营商环境的优化。绿色保险法治评估标准为法治价值和制度设计,法治价值包括效率、公平、秩序,制度设计包括有法可依、做好服务。能否更好地发挥绿色保险对营商环境的优化作用,构成评估绿色保险法治效率价值的标准。通过评估我国绿色保险法治,发现在资金端存在支持险资参与绿色投资力度有待加大“、两手并用”重视程度有待增强、第三方评估和交易平台有待健全等问题,在产品端存在缺乏对市场主体行为的深层次引导、高污染企业参保环责险制度有待完善、环境信息披露机制有待健全、鼓励企业参与绿色保险制度有待落实等问题,对此提出了注重“两手并用”、推动保险公司提高绿色保险服务能力、鼓励保险资金绿色运用、引导丰富完善绿色保险产品健全绿色保险法治的途径。

The rule of law for green insurance is the basic way of green insurance governance,which requires that the basic rule of law values such as order,justice and efficiency should be integrated into the whole green insurance legal system.The premise of implementation is that there is a green insurance legal system that meets the standard of "good law".The importance of the rule of law for green insurance is reflected in indirectly promoting the optimization of the business environment by promoting the development of green insurance.The legal evaluation standard of green insurance is the legal value and system design.The legal value includes efficiency,fairness and order,and the system design includes having laws to follow and providing good service.Whether green insurance can play a better role in optimizing the business environment constitutes a standard for evaluating efficiency value.Through the evaluation of the rule of law of green insurance in China,it is found that there are problems at the capital side which need to be strengthened to support the participation of insurance funds in green investment,the importance of "dual use" needs to be strengthened,and the third-party evaluation and trading platform needs to be fully built.At the product end,there are problems such as lack of in-depth guidance for the behaviors of market players,the environmental liability insurance system for highly polluting enterprises to be improved,the environmental information disclosure mechanism to be improved,and the encouragement of enterprises to participate in green insurance to be strengthened.This paper puts forward some ways to improve the rule of law of green insurance,such as paying attention to both sides,improving ability to provide green insurance services,encouraging green use of insurance funds,and guiding the development of green insurance products.
