征信视阈下信用权司法保护路径研究

A Research on the Path of Judicial Protection of Credit Right From the Perspective of Credit Investigation

征信是信用经济的重要支撑,随着信用信息采集途径和手段的智能化与信息化,信用信息采集范围将不断扩大,也随之带来信用权纠纷数量的迅速上升。通过对征信领域已生效的80份司法裁判文书的对比分析,发现信用权纠纷在司法实务中集中表现出案由适用混乱、侵权行为认定困难以及信息提供主体内控制度缺失等问题。司法裁判的差异性,让研究再次聚焦产生信用权理论争议的缘由和征信领域中信用权本体论,进而从宏观、中观和微观三个不同视角构建以个人信息权益保护路径为主,重视财产利益救济;综合人格权案由适用,重视人格利益救济;健全信息提供主体内控制度,引导纠纷诉前解决等多种机制,以完善信用权纠纷的司法救济路径。

Credit investigation is an important support for the credit economy.With the intelligentization and informatization of credit information collection methods and means,the scope of credit information collection continues to expand,which also brings about a rapid increase in the number of credit rights disputes.Through the comparative analysis of 80 judicial judgment documents that have come into effect in the field of credit reporting,the disputes over the right to credit in judicial practice mainly show the confusion in the application of the cause of action,the difficulty in identifying infringement acts,and the lack of internal control systems for information providers.The differences in judicial judgments make the research focus again on the reasons for the disputes over the theory of credit rights and the ontology of credit rights in the field of credit reporting,and then it proposes the protection of personal information rights and interests through three different perspectives from macro,meso and micro perspectives.It also proposes:Giving more weight to the relief of property interests;distinguishing personal interests infringement scenarios,and comprehensively applying the cause of action for personality rights;establishing a complete internal control system for information providers,guiding various mechanisms for pre-litigation resolution of disputes,and improving the judicial remedy path for credit rights disputes.
