专利联盟理论及对我国创新企业的启示

The Theory of Patent Alliance and Its Enlightenment to My Country’s Innovative Enterprises

在我国高质量发展过程中,党中央、国务院把知识产权保护工作摆在更加突出的位置。目前,我国的专利数量虽然逐步增加,但随之出现了相应的专利丛林“、公地悲剧”等专利问题。专利联盟不仅能够有效缓解以上问题,还能够有效应对外国专利联盟的竞争,因此,需要深入了解专利联盟的相关理论,组建起适合我国创新企业的专利联盟。本研究主要从三个方面来进行论述:首先对专利联盟理论及要求进行了梳理;其次,分析了我国创新企业组建专利联盟的必要性和可行性;最后,基于专利联盟理论的阐述,提供了几点关于我国创新企业组建专利联盟的启示。

In the process of high-quality development, the Party Central Committee and the State Council have placed intellectual property protection in a more prominent position. At present, the number of patents in my country is gradually increasing, but there are also corresponding patent problems such as patent jungle and "tragedy of the commons". The patent alliance can not only effectively alleviate the above problems, but also effectively deal with the competition of foreign patent alliances. Therefore, it is necessary to deeply understand the relevant theories of patent alliances and form a patent alliance suitable for Chinese innovative enterprises. This paper mainly discusses from three aspects: firstly, it sorts out the theory and requirements of patent alliances;secondly, it analyzes the necessity and feasibility of establishing patent alliances for innovative enterprises in my country;finally, based on the elaboration of patent alliance theory, it proposes some enlightenments about the establishment of patent alliances by innovative enterprises in my country.
