跨境电商知识产权海关保护执法模式研究

Research on the Enforcement Mode of Customs Protection of Intellectual Rights in Cross-Border E-Commerce

近年来,我国跨境电商业务快速发展,随之而来的是该领域侵犯知识产权案件时有发生,对国家形象和跨境电商经营者造成了一定的负面影响。海关作为知识产权边境保护执法机关,在查获大量侵权情事的同时,仍然存在一些不足。本研究通过研究明确跨境电商商品的法律属性,进一步优化海关知识产权保护执法模式,推动实施国家知识产权战略。

In recent years, with the rapid development of cross-border e-commerce business in China, intellectual property infringement cases in this field have occurred frequently, which has caused some negative effects on the national image and cross-border e-commerce operators. Customs, as a law enforcement agency for border protection of intellectual property rights, still has some shortcomings while finding a large number of infringements. This study attempts to clarify the legal attributes of cross-border e-commerce commodities, further optimize the customs law enforcement mode of intellectual property protection, and promote the realization of the strategy of intellectual property power.
