中华法系视野下的古代工程建筑法典研究——以《营造法式》为中心的分析

On the Code of Ancient Engineering and Architecture from the Perspective of the Chinese Legal System:Analysis Centered on Yingzao Fashi

中国古代法典体系丰富多元,不仅有律典,也涉及其他领域。工程建筑法典是中华法系法典的重要方面。在此之中,《营造法式》《营缮令》与《擅兴律》互动关系明显,三者构成宋代工程建筑法律体系。《营造法式》作为工程建筑法典代表,在统一建筑样式、管控人工物料及维护礼法制度等方面具有规范功能。在中华法系视野下研究古代工程建筑法典,揭示其法属性,探究其法体系,发掘其法功能,总结其法典化启示,不仅有传承中华优秀传统法律文化之法典维度的理论价值,还有明确当代工程建筑法范畴体系的借鉴价值,更有助力新时代工程管理法治化的实践意义。

The ancient Chinese legal code system is rich and diverse,not only in legal codes,but also in other fields.The engineering and construction code is an important aspect of the inheritance of the Chinese legal code system.Among these,Yingzao Fashi,Decrees and Edicts on Construction and Restoration of National Public Works have obvious interaction with Shanxing Code,which constitute the legal code system of engineering and construction in the Song Dynasty.As a representative of the engineering and construction code,Yingzao Fashi has a normative function in unifying architectural styles,controlling artificial materials,maintaining etiquette and law systems,and so on.From the perspective of inheritance and innovation of the Chinese legal code system,the paper studies the ancient engineering and construction code,reveals its legal attributes,explores its legal system and legal functions,and summarize its codification enlightenment.It has not only the theoretical value of inheriting the code dimension of China’s excellent traditional legal culture,but also the referential value of clarifying the category system of contemporary engineering and construction law.It has practical significance to help the legalization of engineering management in the new era.
