Model Positioning and Realistic Dilemma of Regional Collaborative Legislation

区域协同立法离不开协同二字,既可以通过发布地方性法规也可以通过制定地方政府规章予以体现。区域协同立法的实质为立法机制改革,各地已然涌现颇具特色的实践样态。协同立法存在三个共性问题:协同立法依据缺位、协同立法主体模糊、协同立法范围不明。在未来展望中,协同立法既要聚焦于立法前的必要性分析与规定立法依据,也要搭建信息交流平台,设置交叉备案审查机制,使区域协同立法有法可依。

Regional collaborative legislation is inseparable from coordination,which can be reflected by is⁃suing local laws and regulations or formulating local government regulations.The essence of regional collab⁃orative legislation is the reform of legislative mechanism.After summarizing the existing problems of several practice patterns,three common problems can be found:absence of collaborative legislation basis,fuzzy col⁃laborative legislation subject,and unclear collaborative legislation scope.In the future,it should not only fo⁃cus on the necessary analysis and stipulating the legislative basis before legislation,but also build an infor⁃mation exchange platform and set up a cross-filing review mechanism,so that there are laws to follow for regional collaborative legislation.
