袭警罪的法教义学再审视——以“暴力”相关问题的解释切入

A Review of Dogmatics of Law of Crime of Assaulting a Police Office--From the Angle of the Explanation of“Violence”Related Issues

《刑法修正案(十一)》在《刑法》第277条第5款新设袭警罪,开启了暴力袭警单独成罪的刑法规制模式。从法教义学的角度对袭警罪进行再审视,以法益侵害为基础,厘清袭警罪的保护法益进而明确将袭警罪划为具体危险犯以实现解释和实践层面的周延。袭警罪中的“暴力”的解读应坚持狭义暴力说。“暴力”的程度判断标准围绕具体危险的创造,不以达到轻微伤以上的后果为入罪标准,也不排除对重伤、死亡后果的评价,“严重危及人身安全”的“暴力”的程度则以至少可能造成重伤为标准。

Amendment(XI)to the Criminal Law establishes a new crime of assaulting a police in para⁃graph 5 of Article 277 of the criminal law,which opens the criminal law regulation mode of violent as⁃saulting the police as a separate crime.From the perspective of dogmatics of law,this paper reviews the crime of assaulting the police,clarifies the protection legal interests of the crime of assaulting the police based on the infringement of legal interests,and then clearly classifies the crime as a specific dangerous crime,so as to realize the extension of interpretation and practice.The interpretation of“violence”in the crime of attacking police should adhere to the theory of violence in a narrow sense.The judgment standard of of“violence”focuses on the creation of specific dangers.It does not take the consequences of reaching slight injury or more as the standard of criminalization,nor does it exclude the evaluation of the conse⁃quences of serious injury and death.The degree of“violence”that seriously endangers personal safety is based on the possibility of causing at least serious injury.
