海南自由贸易港建设高标准的负面清单制度路径探析

海南自贸港负面清单制度对海南引进外资、扩大开放具有重要的意义。在海南自贸港建立并完善负面清单制度是海南自贸港建设的重点和难点。目前,自贸港的负面清单制度仍然存在确定性与透明度不足、对外国投资的监管制度不完善、与国际高标准的经贸规则存在很大差距、配套法律法规不完全等诸多问题。借鉴美国、墨西哥、印度尼西亚和国内自贸区负面清单建设经验,海南自贸港可以从提高负面清单设计的前瞻性、结合海南特色、形成多方参与的负面清单决策与评价体系以及对负面清单进行实质性瘦身等方面进一步完善负面清单制度建设。

The negative list system of Hainan Free Trade Port is of great significance for Hainan to intro⁃duce foreign capital and expand its opening up.Establishing and improving the negative list system in Hainan Free Trade Port is the key and difficulty of its construction.At present,the negative list system of free trade ports still has many problems,such as lack of certainty and transparency,imperfect supervision system for foreign investment,large gap with international high-standard economic and trade rules,and in⁃complete supporting laws and regulations.Learning from the negative list construction experience of the United States,Mexico,Indonesia and the domestic free trade zones,Hainan Free Trade Port can implement the negative list in terms of improving the forward-looking design of the negative list,combining the char⁃acteristics of Hainan,forming a negative list decision-making and evaluation system with multi-party partic⁃ipation,etc..
