摘要
劳务派遣是一种灵活的用工方式,用工单位与劳动者之间没有劳动合同关系,通过与派遣单位之间的劳务派遣协议实际使用劳动者。用工单位在享受用工便利的同时,也面临着法律关系、竞业限制、同工同酬等方面的法律风险。用工单位应树立风险意识,选择资信良好的派遣单位,签署好劳务派遣协议,制定好规章制度,依法合规使用派遣工,降低法律风险。
Labor dispatch is a flexible way of employment.There is no labor contract relationship between the employing unit and the laborer.The laborer is actually used through the labor dispatch agreement with the dispatching unit.While enjoying the convenience of employment,employers are facing legal risks in legal relations,competition restrictions,equal pay for equal work and so on.The employing unit shall establish risk awareness and use dispatched workers in accordance with laws and regulations by selecting dispatch units with good credit,signing labor dispatch agreements,formulating rules and regulations and other means to reduce legal risks.
