摘要
立法技术高低直接决定着立法质量好坏,准确认识与理解新《档案法》的立法技术特点与不足是贯彻实施好新《档案法》的逻辑前提与应有之义。新《档案法》是1987版《档案法》制定以来的首次全面修订,本次修订呈现出五个方面的立法技术特点:法律修改采取修订方式、立法目的趋于完善、规范条款设置类别丰富、法律责任内容有所突破以及立法语言运用规范。但在三个方面仍存在立法技术不足:立法目的条款、立法根据以及法律责任条款。新《档案法》的不完善之处,应一分为二地来看待:一是运用立法技术可以避免的不完善;二是通过运用立法技术仍无法解决的不完善。前者是新《档案法》的真正不完善之处;后者非新《档案法》的不完善。
The level of legislation technology directly determines the quality of legislation.It is the logical premise and proper meaning of implementing the new Archives Law to accurately understand the technical characteristics and shortcomings of the new Archives Law.The new Archives Law is the first comprehensive revision since the enactment of the 1987 edition of the Archives Law.This revision presents five legislative technical features:the revision of the law,the improvement of the legislative aim,the variety of the standard provision,the breakthrough of the content of the legal responsibility and the use of the legislative language.However,there are still three legislative technical deficiencies:legislative purpose clause,legislative basis and legal liability clause.The imperfection of the new Archives Law should be divided into two aspects:one is the imperfection that can be avoided by using legislative technique,the other is the imperfection that cannot be solved by using legislative technique.The former is the real imperfection of the new Archives Law,while the latter is not.
