专利引证与专利维持时间的相关性实证

Empirical Research on the Correlation Between Patent Citations and Patent Maintenance Time

[研究目的]专利维持时间是评价专利质量的一项重要指标,然而这项指标数值只有等到专利权终止时才能获知。前瞻性地预见专利维持时间将是一项有意义的专利情报工作。通过研究专利引证与专利维持时间的相关性,为预见专利维持时间提供线索。[研究方法]在专利法视野下研究专利引证的法律属性,在创新经济学视野下研究专利引证的经济效应,在这两项研究的基础上推理假设:专利的“A”类“X”类“Y”类引证以及总引证频次都与专利维持时间正相关。运用Spearman秩相关分析、K独立样本非参数检验两种方法,在样本范围内进行假设检验。[研究结论]研究假设得到确证。各类引证频次越多的专利,其维持时间很可能也越长。该研究结论为预见专利维持时间提供了线索。

[Research purpose]Patent Maintenance Time is one of important indexes for evaluating patent quality,which is a posteriori expression so that it could only be obtained after the patent expired or terminated.Foreseeing the patent maintenance time is in the scope of patent information research.This study aims to provide clues for predicting the patent maintenance time by researching the correlation between patent citation and patent maintenance time.[Research method]Based on the legal attribute of patent citation from the perspective of patent law and the economic effect of patent citation from the perspective of innovative economics,it is assumed that the citation frequency of Type"A""X""Y"and the total are positively related to the patent maintenance time.And Spearman rank correlation analysis and k independent sample nonparametric test were used to test hypotheses in the sample range.[Research conclusion]The research hypotheses were credible significantly.The conclusion expands the information science significance of patent citation,and provides clues for predicting patent maintenance time by patent citation.
