摘要
[研究目的]研究域外算法披露的演进历程,为我国算法的有效监管与规制提供参考。[研究方法]通过借鉴域外立法与实践经验,从强化算法披露等级、构建双轨制算法披露监督机制和落实本土算法披露责任类型化与体系化三方面完善我国算法披露制度。[研究结论]我国有必要从算法披露的初级公开水平过渡到算法具体透明阶段,在算法透明可释原则下对算法的运行逻辑、运行结果、算法参数和影响因子等予以公开;构建“内部自查+外部审查”的双轨制监督机制,在企业内部设立独立算法监督委员会,在外部国家层面统一进行算法披露准则设置和监管执法;落实本土算法披露的民事、行政、刑事责任类型化与过错归责机制的体系化。多管齐下,保障我国算法披露充分、完全,算法结果公平、公正。
[Research purpose]This paper studies the evolution of extraterritorial algorithm disclosure so as to provide a reference for the effective supervision and regulation of algorithms in China.[Research method]Drawing on extraterritorial legislation and practical experience,China can improve the algorithm disclosure system from three aspects of strengthening the algorithm disclosure level,constructing the two-track algorithm disclosure supervision mechanism and implementing local algorithm disclosure responsibility stylization and systematization to improve China's algorithm disclosure system.[Research conclusion]It is necessary for China to gradually transit from the primary disclosure level of algorithm disclosure to the specific transparency stage,which requires that under the principle of algorithm transparency and release,the operating logic,running results,algorithm parameters and influence factors of the algorithm should be disclosed.At the same time,construct the two-track supervision mechanism featured by"internal self-examination+external supervision":establish an independent algorithm supervision committee within the enterprise,unify algorithm disclosure standard settings and supervision of law enforcement at the external national level.And implement the systematization of civil,administrative,and criminal liability types and fault attribution mechanisms disclosed by local algorithms.Under multi-pronged approach,to ensure that China's algorithm disclosure is full and complete,and algorithmic results are fair and just.
