突发事件网络舆情智能治理的P2DR法治保障模式构建

Construction of P2DR Rule of Law Guarantee Model for Intelligent Governance of Network Public Opinion in Emergencies

[研究目的]人工智能作为公共治理创新的技术资源在进行突发事件网络舆情治理时存在一定程度上的异化风险。基于P2DR法治模型,提出网络舆情智能治理的法治保障路径,对于提升突发事件网络舆情治理效能、优化公共行政水平具有重要意义。[研究方法]引入P2DR动态模型,在整体安全策略(P)指导下,将法治理念融入治理技术的顶层设计,发挥理念层面的“防御、甄别、引领”功能。在实践层面,完善以“技术安全”为重点的“准入”制度(P),以“权利保护”为重点的“通过”制度(D)和以“责任落实”为重点的“保障”制度(R)。[研究结论]通过理念与实践层面双向发力,以法治理念监督与纠偏技术规则设计,以法治框架调适和规约智能技术的治理权限,构建出一套协同完善的智能治理技术风险P2DR法治保障模式。

[Research purpose]As a technical resource for public governance innovation,artificial intelligence has a certain degree of alienation risk in the management of network public opinion in emergencies.Based on the P2DR rule of law model,this paper puts forward the rule of law guarantee path of network public opinion intelligent governance,which is of great significance to improve the efficiency of network public opinion governance in emergencies and optimize the level of public administration.[Research method]By introducing P2DR dynamic model,under the guidance of overall security strategy(P),the concept of rule of law is integrated into the top-level design of governance technology to give play to the function of"defense,screening and guidance"at the concept level.At the practical level,improve the"access"system(P)focusing on"technical security",the"pass"system(D)focusing on"right protection"and the"guarantee"system(R)focusing on"responsibility implementation".[Research conclusion]Through the two-way efforts at the conceptual and practical levels,supervise and correct the technical rule design with the concept of rule of law,adjust and regulate the governance authority of intelligent technology with the rule of law framework,and build a set of coordinated and perfect P2DR rule of law guarantee mode for intelligent governance Technology risk.
