中国的法治建设要有自己的文化根据,延绵数千年的中华优秀传统文化是我国法治建设的丰富资源。从历史唯物主义视角辩证看待传统文化对法治建设的影响,有鉴别地对待、有扬弃地继承传统文化,立足国情世情坚持推陈出新、古为今用,实现中华优秀传统文化的创造性转化和创新性发展,充分总结我国法治建设的文化经验,为我国法治建设提供当代智慧和现代意义,探索现代法治国家建设的实践进路。

The construction of the rule of law in China should be based on its own culture.The Chinese excellent traditional culture has lasted for thousands of years,which is a rich resource for the construction of the rule of law in China.We should have a dialectical perspective on the impact of traditional culture on the construction of the rule of law on the basis of historical materialism.We should refine and inherit the traditional culture,innovate and upgrade the resources according to the national and world conditions,to realize the creative transformation and innovative development of China’s excellent traditional culture.We should utilize China’s cultural experience in the construction of the rule of law,which can provide reference and guidance for China’s construction of the rule of law,enable us to explore the practical approach of building a modern country ruled by law.
