“水行政执法+检察公益诉讼”协作机制构建与发展思考——以农村饮水安全监管为视角

On Building and development of the cooperative mechanism of “water administrative law enforcement+procuratorial public interest litigation”——From the perspective of supervision of rural drinking water safety

强化水利体制机制法治管理,是不断提升新阶段水行政执法能力与水平的重要途径,是全面提升国家水安全保障能力的有力支撑。文章总结了建立数据共享机制、强化流域治理管理、协同监管农村饮水安全工程等主要内容,阐明了“水行政执法+检察公益诉讼”协作机制对全国乡村振兴水利工程建设、巩固脱贫攻坚成果的贡献意义。在分析水利部开展的专项调研活动与地方实践的基础上,提出了夯实该协作机制的分权制衡理论基础、健全联席会议制度、共同制作指导建议、创新农村饮水安全协作管理模式等完善建议。

Strengthening law-based governance of water conservancy systems and mechanisms is an important means to improving water administrative law enforcement in the new stage and a strong support for enhancing the guarantee capacity of national water security. This paper summarizes the main contents of establishing a data sharing mechanism, strengthening river basin governance and management, and coordinating the supervision of rural drinking water safety projects. It also expounds the significance of the cooperation mechanism of “water administrative law enforcement + procuratorial public interest litigation” in revitalizing the construction of water conservancy projects in rural areas and consolidating the achievements of poverty alleviation. Based on the analysis of the special field surveys carried out by the Ministry of Water Resources and local practices, this paper puts forward recommendations in this regard, including consolidating the theoretical basis(balancing the administrative power and the judicial power) of the cooperation mechanism, improving the joint meeting mechanism, jointly proposing guidance recommendations, and innovating the cooperative management mode for ensuring rural drinking water safety.
