公司化黑社会性质组织犯罪治理路径探究

公司化黑社会性质组织犯罪是传统黑恶势力犯罪新的手法和表现形式,黑社会性质组织借助形式上合法的公司、企业实施犯罪活动,以商养黑、以黑护商,加速向经济领域渗透,内部结构更加严密,组织化程度更高,在掩饰非法经济来源的同时追求经济垄断。其犯罪活动呈现出敛财方式多样化、组织结构层级化、人员组成年轻化、犯罪手段软暴力化等特征,致使在治理过程中存在着案件认定难、线索搜集难、侦查取证难、侦查经营难、合力打击难等困境。公安机关应当树立智慧侦查理念,实行转变侦查策略、重视合成作战、严密法律制度体系、加强经济组织建设等措施,以实现对公司化黑社会性质组织犯罪的有效治理。

Corporatized underworld organized crime is a new method and form of crime by traditional underworld forces.Underworld organizations use legal companies and enterprises to carry out criminal activities,support the black with business and protect the black with business,accelerate the penetration into the economic field,make the internal structure more rigorous and more organized,and pursue economic monopoly while covering up illegal economic sources.Its criminal activities show the characteristics of diversified ways of collecting money,hierarchical organizational structure,younger personnel composition and soft violence of criminal means,resulting in difficulties in the process of governance,such as case identification,clue collection,investigation and evidence collection,investigation and operation,joint strike and so on.The public security organs should establish smart investigation concept,change the investigation strategy,pay attention to synthetic operations,strict legal system,and strengthen economic organization construction,so as to achieve effective governance of criminal organization organized by gangland.
