未成年人犯罪司法机关协调配合机制研究——以刑事责任年龄降低为视角

Research on Coordination Mechanism of Judicial Branch for Juvenile Delinquency from the Perspective of Lower Age of Criminal Responsibility

《刑法修正案(十一)》对刑事责任年龄进行了有条件的降低,低龄未成年人犯罪预防与保护成为了更加重要的研究课题。受制于机构权责划分,少年司法职能分配在现有的各个司法机关中,而对于司法机关之间如何协调配合缺乏整体化的考量。为完善未成年人犯罪的预防、矫治工作,减少在未成年人进入司法流程后,司法程序对未成年人的影响,司法机关之间应建立起一套衔接配合、互相监督、互相制约的工作体系。

Amendment( Ⅺ) to the Criminal Law of the People’s Republic of China has reduced the age of criminal responsibility conditionally,it becomes a major research topic to prevent and protect younger juvenile delinquency. Because of the division of powers and responsibilities of institutions,juvenile judicial functions are distributed among the various judicial branch,however,it is the lack of overall consideration on how to coordinate and cooperate among judicial branch. In order to improve the prevention and correction of juvenile delinquency,it shall establish a system of coordination and mutual supervision among judicial branch to reduce the impact of judicial procedures on minors entering the judicial process.
