民法典视野下高校法治教育新论

Education into the College Students Legal Education

加强大学生民法典教育是当前高校法治教育的重点任务。在法制教育向法治教育转型的大背景下,高校法治教育应借助民法典宣教的机会开展法治文化建设,加强法治精神的培育和法治意识养成。就价值理念维度而言,民法典教育需要帮助大学生培养平等精神,根植契约精神,养成平等待人、公平处事的良好习惯,树立信守承诺,公正互惠的价值追求。就思维意识维度而言,民法典教育需要帮助大学生培育维权意识和公益意识,造就依法维护私人合法权益的法律意识,形成尊重公共秩序、遵守社会公德的法治思维。就制度规范维度而言,民法典教育要向大学生宣传民法典的重要制度,讲解民法典的创新规定。高校民法典教育应致力于将价值理念培育、思维意识养成和制度规范学习巧妙融合,克服传统法治教育偏重法律知识传授而忽略法律价值培养的短板缺陷,从而真正实现知识传授与价值引领的有机统一。

Strengthening the publicity and education of the Civil Code is the key task of legal education in colleges and universities. Under the background of the transformation of legal education,legal education in colleges and universities should take advantage of the opportunity of civil code education to carry out the construction of legal culture,and strengthen the cultivation of the spirit of the rule of law and the cultivation of the rule of law consciousness. In terms of the dimension of value concept,the civil code education should help college students cultivate the spirit of equality,be rooted in the spirit of contract,develop good habits of dealing with equals and fair,and establish the value pursuit of commitment,fair and mutual benefit. In terms of the dimension of consciousness,the civil code education should help college students to cultivate their awareness of rights protection and public welfare,establish a legal awareness of safeguarding private legitimate rights and interests in accordance with the law,and form the rule of law thinking ways respecting public order and abiding by social ethics. In terms of the dimension of system norms,the civil code education should publicize the important system of the Civil Code to college students and explain the innovative provisions of the Civil Code. The civil code education in colleges and universities should be committed to integrating the cultivation of value concepts,thinking consciousness and system norms,and overcome the shortcomings that the traditional legal education focuses on legal knowledge teaching while ignoring the cultivation of legal value,so as to truly realize the organic unity of knowledge teaching and value guidance.
