社会力量参与图档事务法条比较分析——基于《公共图书馆法》和新《档案法》

社会力量是图档事业持续健康发展的生力军,相继颁布实施的《公共图书馆法》和新《档案法》为社会力量参与图档事务提供了政策引导和法律保障。文章以两部法律中有关社会力量参与的法律条文为依据,对其内容进行比较分析,发现二者既有共性也有差异,以及在法律责任、参与方式、奖励激励制度等方面的不足,并提出相应的改进建议。

Social forces are the new force for the sustainable and healthy development of the Library and Archives career.The public Library Law and the new Archives Law have provided policy guidance and legal guarantee for social forces to participate in the library and Archives affairs.Based on the legal provisions concerning social force participation in the two laws,this paper makes a comparative analysis of their contents,and finds that there are similarities and differences between the two laws,as well as deficiencies in legal responsibility,participation mode,reward and incentive system,and puts forward corresponding suggestions for improvement.
