建国以来中国共产党推进法治建设的历史演进与启示

Historical Evolution and Enlightenment of the Chinese Communist Party to Promote the Legal Construction since the Founding of the People’s Republic of China

建国以来,中国共产党推进法治建设的历程在曲折中前进并实现了跨越式发展,以改革开放、党的十五大、党的十八大三个时间节点为依据可将历史进程划分为四个阶段。从新中国成立到十一届三中全会召开之前,我国法制建设工作在曲折中发展;十一届三中全会以后,法制工作得到恢复与重视,“法治”思想逐渐形成;党的十五大后,法治建设在国家治理实践中创新发展,依法治国成为治国理政的基本方略;党的十八以来,中国特色社会主义法治理论得到进一步深化,习近平法治思想形成,法治建设开启新征程,这也表明党注重发挥法治在国家治理和社会管理中的重要作用。回顾历史进程,总结经验教训,要坚持党的领导与依法治国相统一、坚持和完善中国特色社会主义法治体系、营造尊法学法守法用法的良好氛围,不断加强新时代“法治中国”建设。

Since the founding of the People’s Republic of China, the Communist Party of China’s process of promoting the construction of the rule of law has advanced in twists and turns and achieved leapfrog development.Based on the three time nodes of reform and opening up, the 15th National Congress of the CPC and the 18th National Congress of the CPC,the historical process can be divided into four stages.From the founding of new China to the Third Plenary Session of the Eleventh Central Committee of the Communist Party of China, China’s legal construction has developed in twists and turns.After the Third Plenary Session of the Eleventh Central Committee, the legal work was restored and valued, and the idea of “rule of law” was gradually formed.After the 15th National Congress of the CPC,the construction of the rule of law developed innovatively in the practice of national governance, and the rule of law became the basic strategy of state governance.Since the 18th National Congress of the CPC,the socialist rule of law theory with Chinese characteristics has been further deepened, Xi Jinping’s thought on the rule of law has taken shape, and construction of the rule of law has embarked on a new journey.It shows that the CPC attaches great importance to the role of rule of law in national governance and social management.Reviewing the historical process and drawing experience from it, we need to integrate the Party leadership with law-based governance, uphold and improve the socialist system of rule of law with Chinese characteristics, create a favorable atmosphere in which the law is respected, observed, and applied, and constantly strengthen the building of “rule of law in China” in the new era.
