伴随信息技术的迅猛发展,毒品犯罪开始从现实空间转向网络空间,禁毒工作面临严峻挑战。网络毒品犯罪是一种全新场域的犯罪类型,较传统毒品犯罪而言,具有犯罪主体复杂,行为手段多样,施害范围广泛,社会危害严重的特点,有严加规制,有效应对的必要性。引入中国裁判文书网200例网络毒品犯罪典型案件,全面剖析网络毒品犯罪的主体特征、行为模式和刑罚处罚,积极寻求网络毒品犯罪的治理对策。网络毒品犯罪以松散的犯罪网络替代严密的犯罪组织,不断细化制造、贩卖、运输毒品的共犯分工,应聚合多元社会力量,形成打击合力。网络毒品犯罪借助网络平台发布涉毒信息,依托即时通讯软件进行意思联络,联袂物联网络展开毒品运输,倚靠在线支付工具实现无痕交易,形成上中下游联系紧密的黑色产业链,应强化电子取证技术应用,构建信息共享平台予以全链条打击。由于网络毒品犯罪具有打破区域限制,自由切换境内境外交易地点的特点,所以,应加强国际合作,致力全球治理。

Along with the rapid development of information technology,drug crimes have shifted from real space to cyberspace,and anti-drug work is facing severe challenges.Cyber drug crime is a new type of crime in a new field,with the characteristics of complex criminal subjects,various means of behavior,a wide range of harm,and severe social harm compared with the traditional drug crimes.We introduce 200 typical cases of cyber drug crimes on China s Judicial Documents website,comprehensively analyze the characteristics of cyber drug crimes subjects,behavior patterns and penalties,and actively seek countermeasures to govern cyber drug crimes.Cyber drug crimes replace strict criminal organizations with loose criminal networks,and constantly refine the division of complicity in drug manufacturing,trafficking,and transportation,which should bring together multiple social forces to form a joint effort to combat them.Cyber drug crimes use online platforms to release drug-related information,rely on instant messaging software to communicate with each other,cooperate with the Internet of Things network to carry out drug transportation,and rely on online payment tools to achieve seamless transactions.Thus,this type of crime forms a black industrial chain with close ties between the upper,middle and lower reaches,which should be strengthened with the application of electronic forensic technology and the construction of an information-sharing platform to combat the whole chain.Cyber drug crimes break regional restrictions and freely switch between domestic and overseas trading locations,so international cooperation should be strengthened,and global governance should be committed.
