预测警务模式下的企业犯罪治理路径探索

Exploration on the Governance Path of Enterprise Crime under the Model of Predictive Policing

预测警务在信息技术的推动下已成为各国警务研究的热点。国外警方为解决街面犯罪问题而将犯罪时空、群体预测作为预测警务的主要研究方向,但因涉嫌侵犯隐私、污名化少数族裔、治理成效性价比不高而受到质疑。国内司法机关受优化营商环境的政策影响,开始重新审视预测警务在企业犯罪治理上的潜力。随着合法性、必要性、可行性等条件的具备,部分地区公安机关开始了以预测警务技术治理企业犯罪的实践。经过初步尝试,以企业犯罪风险评估为核心的企业犯罪治理机制取得了明显成效,但也存在一些瓶颈有待突破。对此,需进一步立足警务工作实际,加强警校企之间的研究合作,不断融入社会治理体系,以此促进国内预测警务在企业犯罪治理领域的应用发展。

With the support of information technology,predictive policing has become a hot topic in policing research in various countries.In order to solve the problem of frequent street crimes,foreign police take crime time and space and group prediction as the main research direction,but they are questioned because they are suspected of violating privacy,stigmatizing ethnic minorities,and the low-cost effectiveness.Influenced by policies to optimize the business environment,domestic judicial authorities have begun to re-examine the potential of predictive policing in corporate crime governance.At the moment when the legality,necessity,feasibility and other conditions are met,police in some regions have begun to apply predictive policing technology to control corporate crimes.After preliminary attempts,the corporate crime governance mechanism centered on corporate crime risk assessment has achieved gratifying results,but there are still some bottlenecks.In this regard,based on the reality of police work,this paper puts forward suggestions to strengthen the research cooperation between police schools and enterprises and integrate into the social governance system,so as to promote the application and development of domestic predictive police in corporate crime governance.
