《民法典》中“依法”的规范功能

Normative Functions of “in Accordance with Law”in Civil Code of People sRepublic of China

我国《民法典》中“依法”的规范功能包括规范衔接功能、价值补充功能以及体系修补功能。其中,发挥规范衔接功能的“依法”多具有实义,充当连通相关规范的媒介,实现了对传统引致规范形式和实质上的补充;价值补充功能主要由不具有实义的“依法”承担,其赋予法官在个案中根据私法价值与公法价值再行衡量的权力;体系修补功能则在于平衡“稳定”与“变化”的立法悖论,助力法典化的立法修正及体系整合。但是,“依法”在表现形式以及功能用法上均未能在《民法典》中一以贯之,实为立法缺憾。

The normative functions of“in accordance with law”in Civil Code of People s Republic of China include norm-connected function,value-added function and system-repaired function.Among them,“in accordance with law”,which plays norm-connected function,has substantive meaning,acts as a medium to connect relevant norms,and realizes the formal and substantial supplement to the traditional induced norms.The value-added function is mainly undertaken by“in accordance with law”,which has no substantive meaning,and gives judges the right to judge according to the value of private law and public law in individual cases.The system-repaired function lies in balancing the legislative paradox of“stability”and“change”and helping the legislative amendment and system integration of codification.However,the pragmatic expression and functional usage of“in accordance with law”are not consistent in the civil code,which is actually a legislative defect.
