立法完美主义的危害及其克服

The Harm of Legislative Perfectionism and its Solution

个体的完美主义危害身心健康,组织的完美主义危及国家和社会目标的实现。存在于我国当前社会中的立法完美主义心态肇基于对法律的万能假设和对一时性、非常态化问题的“不能容忍”,其本质是大陆法系立法唯理论在我国的极端化表达。立法完美主义具有许多弊端,其忽视了司法实践对法律的真实需求和司法续造法律、解释法律和生成裁判规则的内在功能,加剧了立法和司法之间的割据。“立法完美”实际导致了“立法无效”“立法滞后”。在中国特色社会主义法律体系已经建成的情况下,立法者应当谦抑,克服立法完美主义心态。对此,建构立法理由说明制度不失为一种可行的方案,将案例指导制度改造成为中国式的判例制度,激活司法的“造法”功能,才是中国未来法制发展的基本途径。

The individual psychogenic perfectionism is detrimental to health,and the systematical and cultural per⁃fectionism endangers the achievement of organizational objectives.The legislative perfectionism existing in Chinese cur⁃rent legal culture originates from the omnipotence assumption to law and the intolerance to the temporary and abnormal problems.Its essence is the extreme performance of the legislative rationalism of civil law system reflecting in China.Leg⁃islative perfectionism has many drawbacks.It ignores the real demand of the judicial practice practice for the law and the intrinsic function that judicature can make the law,interpret the law and generate adjudication rules,which exacerbates the separation between legislation and judicature.Legislative perfectionism actually leads to invalid legislation and legis⁃lation lag.Under the circumstance that the socialist legal system with Chinese characteristics has been established,the legislators should be modest and restrained,and overcome the mentality of legislative perfectionism.In order to solve this problem,a feasible plan is to construct the legislative reason explanation system.The fundamental way for the devel⁃opment of the rule of law in China in the future is to transform the case guiding system into legal precedent system with Chinese characteristics and activate the legislative function of judicature.
