摘要
近年来,外国人在华非法就业问题凸显,给我国社会治理带来新挑战。我国现有的关于外国人在华非法就业的法律法规位阶较低,立法尚未成体系,部分内容相对滞后,加之缺乏宏观调控政策,这都在一定程度上导致管理涣散、治理成本高、违法韧性强等问题。建议统一劳动政策与立法,加大对非法雇佣单位和劳工的惩处力度,并试点签证改革,加强宏观政策调整有效治理外国人在华非法就业问题。
In recent years,illegal employment of foreigners in China has become a prominent issue,posing new challenges to social governance.Existing relevant laws and regulations on illegal employment of foreigners in China are of low rank,scattered,rigid and lagging legislation,resulting in lax employment management of foreign⁃ers in China,high governance costs,strong resilience and other problems.It is suggested to unify labor policies and legislation,strengthen the punishment of illegal employers and workers,pilot visa reform,and effectively deal with the problem through macro policy adjustment.
