短视频著作权保护问题研究

Research on Copyright Protection of Short Video

作为网络媒体技术的新兴产物之一,短视频被普遍认为属于著作权法所称“作品”范畴内的表达形式。伴随移动互联网的迅猛发展和普及,短视频的侵权与保护等问题逐渐成为社会舆论焦点。短视频市场竞争失序及互联网环境下维权方式的复杂化导致短视频著作权维权困难。基于此,本文提出可以从完善法律依据、加大平台义务、加强执法司法衔接及加强“红旗原则”的适用四个方面完善短视频著作权的保护。

As one of the emerging products of online media technology,short videos are generally considered to belong to the category of“works”under copyright law.As one of the emerging products of online media technology,short videos are generally regarded as forms of expression within the scope of“works”under copyright law.Along with the rapid development and popularity of mobile Internet,the issues of infringement and protection of short videos have gradually become the focus of public opinion.The disorderly competition in the short video market and the complexity of the right protection methods in the Internet environment have made it difficult to defend the copyright of short videos.Based on this,this paper proposes that the protection of short video copyright can be improved in four aspects:improving the legal basis,increasing the obligations of the platform,strengthening the judicial connection of law enforcement and enhancing the application of the“red flag principle”.
