“人与自然生命共同体”超越了中西方传统哲学对人与自然关系的认识,是习近平对人与自然关系理论的原创性贡献。“人与自然生命共同体”命题,不仅实现了中国传统哲学理念“天人合一”的现代性转换,同时将中华传统生态智慧所追求的“和合”价值与可持续发展相融合,为重新认识、界定法律上的人与自然关系提供了世界观和方法论指引。“人与自然生命共同体”立足于构建人与自然之间和谐关系,延拓人类观为生态文明法治奠定人性基础,拓展自然观为生态文明法治建立系统思维,发展法律观为生态文明法治汇聚整体性方法。“人与自然生命共同体”命题转化为“用最严格制度最严密法治保护生态环境”的法治实践,要进一步补齐生态环境立法短板、以法治促进和保障生态文明体制改革、推进环境司法专门化、鼓励社会公众参与生态环境治理。
