新时代中国航运法律本科专业教育培养模式之反思

Reflections on the Cultivation Mode of the Undergraduate Education of Shipping Law in China in the New Era

航运法律是以海商法为中心的法律领域,同时也是典型的特色法学专业。航运法律专业教育在本科阶段应当设置较为全面的基础法学课程,兼顾通识与特色;同时,不宜设置大量的实务类课程,而仍应以理论教学为主。可以专题讲座的形式有计划地定期邀请实务部门人员授课,目的是为学生提供对于航运法律实践的描述性了解;同时在实践教学环节开设“案例研讨与模拟庭审”和“法律写作”等课程,适当培养学生在法律领域的分析表达能力。《法学类专业教学质量国家标准》规定的核心课程、航运法律涉及的周边学科课程、法理学、民法课程群、商法、国际经济法、英美法、航运法律课程群、海事国际私法等课程如何安排较为合理,应是本科阶段航运法律专业教育课程体系的主要争点。

Shipping law is a legal field focusing on maritime law,and is also a typical specialty of law.However,at the undergraduate level,it is still essential to set up comprehensive basic law courses,taking into account both general knowledge and special features;at the same time,it is not appropriate to arrange a large number of practical courses and the focus should still be on the theoretical teaching.The experts from the practical departments can be invited to give special lectures periodically as being planned,with the aim of providing students with a descriptive understanding of the practice of shipping law;at the same time,courses such as“Case Study and Mock Trial”and“Legal Writing”should be offered in the practical teaching sessions to properly train the students’analytical and expressive skills in the legal field.The main moot points in the curriculum of shipping law education at the undergraduate level are how to arrange the followings in the course structures:the core courses stipulated in the National Standard for Quality of Teaching in Law,the courses of peripheral disciplines involved in shipping law,jurisprudence,the civil law course cluster,commercial law,international economic law,common law,the shipping law course cluster and international conflict of maritime laws.
