摘要 学位授予品行标准的实践有待于深度阐释。适用品行标准的主体包括高校和法院,它们在如何适用品行标准问题上表现出高度一致性。学位授予细则中,品行标准包括原则性条款和操作性条款,操作性条款可以分为行为型、处分型和兜底型,条款的形式和内容多样化。在品行标准合法性审查中,法院主要持肯定立场。品行标准的功能有助于理解相关主体集体选择的逻辑。人才培养、学生管理和制度创新构成了学位授予的三项隐性功能。这些功能最终能否实现取决于相关主体在司法领域的博弈,品行标准的现状是高校、学生和法院等主体冲突与妥协的结果。 The present practice of the moral standards for academic degree award needs to be explained in depth.The subjects who are applied with the standards of conduct include those participants in universities and courts.The participants show a high degree of consistency in ways to apply the standards of conduct.In the rules of academic degree award,the standards of conduct include principle clauses and operational clauses.Operational clauses can be divided into behavior types,punishment types and“miscellaneous provision”types.The form and content of the clauses are diversified.In the legality review of the standards of conduct,the court mainly held a positive position.The function of standards of conduct helps to understand the logic of collective selection of relevant subjects.As for the talent cultivation,student management and system innovation constitute the three hidden functions of academic degree award.The exertion of those functions depends on the games of relevant subjects in the judicial field.The current status of the standards of conduct is the result of conflicts and compromises among subjects such as universities,students,and courts.
