数字业态中的算法捆绑困境与政府规制

Study on Algorithm Bundling Dilemma and Government Regulation in Digital Format

信息社会和人工智能时代的到来,人类社会进入第四次科技产业革命。本文讨论分析了数据作为生产要素嵌入产业生产活动和经济发展模式对传统就业形态产生的影响,并指出数字平台凭借自身已有算法技术对劳动者劳动过程进行支配,同时不断弱化两者之间原有的劳动关系,导致算法捆绑困境的产生,由此带来的社会负效应不容忽视。基于此,特殊建议政府主体积极介入算法事前设计、事中监管、事后救济三环节中,以规制嵌入商业领域的算法权力,保障数字业态职业劳动者的合法权益。

With the advent of the information society and artificial intelligence era,human society has entered the fourth technological industrial revolution.This paper aims to discuss and investigate the impact of data as a factor of production embedded in industrial production activities and economic development models on traditional employment patterns,and point out that digital platforms dominate the labor process of workers by virtue of their existing algorithmic technology,while constantly weakening the original relationship between them,leading to the emergence of the algorithmic bundling dilemma,which brings negative social effects that cannot be neglected.In consideration of this,it is recommended that government entities should be actively involved in the three links of algorithm pre-design,inprocess supervision,and post-event remedy to regulate the algorithmic power embedded in the commercial field and protect the legitimate rights and interests of professional workers in the digital format.
